This Domain Registration Agreement (hereinafter the "Agreement") governs and sets forth the terms and conditions of your use of the Domain Registration and related services ("Services") provided by Dotname Korea Corp. ("Dotname", "we", "our" or "us") and its related entities. In this Agreement, the terms "you" and "yours" refer to you, including your agents, heirs, assigns and successors.
1.1. General. Dotname Korea Corp. is a registrar that accredited from the Internet Corporation for Assigned Names and Numbers ("ICANN") for generic top-level domain names ("gTLDs"), registered as an IANA ID 1132. By using the Services, you agree to all terms and conditions of this Agreement and any rules, policies, or agreements that may be adopted or enforced by the ICANN, any top-level domain ("TLD") Registry Operators ("Registery") and governments, including but not limited to the Uniform Domain-Name Dispute-Resoultion Policy ("UDRP") and the Uniform Rapid Suspension Policy ("URS"). In addition to gTLDs, we are also a registrar of certain country-code top-level domain names ("ccTLDs"). On certain circumstances, we may choose to utilize subcontractors to provide the Services. The Service should not be used for any unlawful purpose.
1.2. Application. You may submit applications to register, transfer or renew domain names ("Application"). By submitting us an Application, you acknowledge and agree that we would not guarantee that you will be able to register, renew, extend or obtain the domain name as you desired. Submitting your Application to us, or making a payment for the Application may not constitute a guarantee of successful operation that you want to.
1.3. Licensing. Even if in the event you license use of Services (including but not limited to a registered domain names) to a third party, you warrant that you would be remain as a Registrant of Record for the registered domains and shall contractually compel any such third party licensee to abide by this Agreement. You accept all liability for harm caused by the wrongful use of a Domain Name licensed to a third party licensee by you.
1.4. Grace Periods. After the expiration date for the gTLD domain names, you will have a Renewal Grace Period of twenty (20) days during which may reimburse Dotname for the renewal. However, please be notified that there is no Renewal Grace Period for some gTLDs and ccTLDs after their expiration, including but not limited to: .jp, .de, .eu, .tw, .uk, .cn. After the Renewal Grace Period, Dotname may place domain names to Deletion period. On the first thirty (30) days during the Deletion Period, you may able to redeem your domain by paying a Redemption fee, which is currently one hundred (100) U.S. Dollars, to Dotname. If you do not redeem your domain name prior to the end of the 30-day redemption period we may, in our sole discretion, delete your domain name, or transfer to another registrant.
1.5. Transfer. The person named as Registrant on the WHOIS record or its technical successors, including the Registration Data Access Protocol ("RDAP"), shall be the "Registered Name Holder" ("RNH"). You and the RNH agrees that prior to transferring the registration of your domain name to another person ("Transferee"), you have to require the Transferee to agree and to be bound by all the terms and conditions of Dotname, including but not limited to this Agreement. If the Transferee fails to be bound in a reasonable fashion as determined by Dotname in its sole discretion to the terms and conditions, any such transfer will be null and void.
The Account holder shall additionally be a designated agent for the registered name holder for the purpose of confirming compliance with these terms and for authorizing transfers of domain name(s) held within the account in accordance with the ICANN Transfer Policy.
1.6. Disputes. You agree and bound to all ICANN (or its succesor's) policies and any relevant policies of Registry Operator and Registrars, including but not limited to: the UDRP and the URS, along with their Supplimental Rules, if applicable. You agree that, in the event of a dispute in relation to a domain name, that we may assess a dispute administrative fee of $50 per domain in addition to any costs and fees incurred by us and charge such fees at our sole discretion.
Dotname reserve the right, in our sole and absolute discretion, to change or modify this Agreement, and any agreements and policies which are incorporated herein, at any time, and such modifications shall be effective immediately upon posting to this website. If you do not agree to be bound by revised agreement and policies, do not use, or continue to use this site and any service provided by us. In addition, we may notify you of changes or modifications to agreements and policies including the Agreement by electronical methods, including but not limited to email. Therefore, it is very important to keep your Dotname account ("Account") information up to date. We takes no responsibility for, and assumes no liability for your failure to receive an electronical notification if such failure results from inaccurate or outdated Account information.
As consideration for the Services, you agree to pay the applicable fees prior to the effectiveness of a desired domain name registration or any renewal thereof. All fees payable hereunder are non-refundable even if your domain name registration is suspended, cancelled or transferred prior to the end of your current registration term.
THE SERVICES ARE PROVIDED TO YOU "AS IS." EXCEPT FOR OUR STATEMENT REGARDING OUR ACCREDITATION AS AN ICANN-APPROVED DOMAIN NAME REGISTRAR, DOTNAME MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND WHATSOEVER, EXPRESS OR IMPLIED, IN CONNECTION WITH THIS AGREEMENT OR THE SERVICES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. WITHOUT LIMITING THE FOREGOING, DOTNAME MAKES NO REPRESENTATIONS OR WARRANTIES THAT REGISTRATION OR USE OF A DOMAIN NAME UNDER THIS AGREEMENT WILL IMMUNIZE YOU EITHER FROM CHALLENGES TO YOUR DOMAIN NAME REGISTRATION(S), OR FROM SUSPENSION, CANCELLATION OR TRANSFER OF THE DOMAIN NAME(S) REGISTERED TO YOU. YOU AGREE THAT DOTNAME, ICANN AND/OR ANY REGISTRY OPERATOR WILL NOT BE LIABLE, UNDER ANY CIRCUMSTANCES, FOR ANY (i) SUSPENSION, LOSS, OR MODIFICATION OF YOUR DOMAIN NAME REGISTRATION, (ii) USE OF YOUR DOMAIN NAME REGISTRATION, (iii) UNAVAILABILITY OF SERVICES OR ANY FEATURES THEREOF, OR ANY INTERRUPTION OF BUSINESS, (iv) ACCESS DELAYS OR ACCESS INTERRUPTIONS TO THIS SITE, YOUR ACCOUNT AND/OR THE WEB SITE(S) OR OTHER SERVICES ASSOCIATED WITH YOUR DOMAIN NAME REGISRATIONS, (v) DATA NON-DELIVERY, MIS-DELIVERY, CORRUPTION, DESTRUCTION OR OTHER MODIFICATION, (vi) EVENTS BEYOND DOTNAME'S OR ANY REGISTRY OPERATOR'S REASONABLE CONTROL, (vii) THE PROCESSING OF YOUR DOMAIN NAME APPLICATION OR OTHER SERVICE APPLICATION, (viii) APPLICATION OF ANY RELEVANT DISPUTE POLICY OR ANY OTHER ICANN (OR SIMILAR GOVERNMENTAL OR SUCCESSOR ORGANIZATION) ADOPTED POLICIES, (ix) THE MISUSE OF YOUR USERNAME AND PASSWORD, OR (x) LOSSES RESULTING FROM ERRORS, OMISSIONS OR MISSTATEMENTS IN ANY INFORMATION OR SERVICES PROVIDED UNDER THIS AGREEMENT.
NEITHER DOTNAME NOR ANY REGISTRY OPERATOR WILL BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING LOST PROFITS) REGARDLESS OF THE FORM OF ACTION WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, EVEN IF DOTNAME AND/OR ANY REGISTRY OPERATOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL DOTNAME'S AND/OR ANY REGISTRY OPERATOR'S MAXIMUM AGGREGATE LIABILITY EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THE SERVICES, BUT IN NO EVENT FIFTY DOLLARS ($50.00). BECAUSE SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH STATES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
You agree to defend, indemnify and hold harmless Dotname, ICANN and/or any Registry Operator (including any parents, subsidiaries, shareholders, members, officers, directors, employees, affiliates, agents and subcontractors of Dotname, ICANN and/or any Registry Operator) from any third party claim, action or demand, resulting in loss, damages or costs (including reasonable attorney's fees and expenses) due to, arising out of or related to: (i) Your use of the Services, (ii) Your application for and registration of, or failure to register or renew, a particular domain name; (iii) Your use of any domain name registered in Your name; (iv) Your breach of this Agreement; (v) any disputes involving the intellectual property rights of others; (vi) processing any registrant transfers in accordance with this Agreement; and (vii) Your use of any domain name affected by any transfer of registrant request. This indemnification is in addition to any indemnification required under the UDRP or any similar policy.
